Terms of Service

These Terms of Service ("Terms") govern your use of The Aware Traveler (the "Service") operated by The Aware Traveler ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that you are at least 18 and have the legal capacity to enter into these Terms.

Your Account

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your information to keep it accurate
  • Keep your password confidential and secure
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activity that occurs under your account

You may not impersonate others, use false information, or create accounts on behalf of someone else without authorization.

Your Content

The Service allows you to create and share content including trip itineraries, notes, photos (via external links), tips, reviews, and other materials ("Your Content").

Ownership

You retain ownership of Your Content. You are solely responsible for it.

License to Us

By submitting Your Content to the Service, you grant The Aware Traveler a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, modify (for technical purposes such as resizing), and distribute Your Content as necessary to operate the Service and as you direct (for example, sharing a trip publicly).

Public Content

When you make a trip or tip public, you grant other users the right to view that content and share its link. Public content may be cached, indexed by search engines, or referenced by other users. You can change visibility settings at any time, but we cannot guarantee removal from external caches or third-party copies.

Your Responsibilities

You agree that Your Content:

  • Does not violate any law or third-party rights (including intellectual property and privacy)
  • Is not defamatory, threatening, harassing, hateful, obscene, or otherwise objectionable
  • Does not contain malware, spam, or deceptive content
  • Does not impersonate any person or entity
  • Does not contain photos of others without their consent
  • Does not promote illegal activity

Photo Links

The Service does not host photos directly. You can paste links to photos hosted on third-party services (Instagram, Google Photos, etc.). You are responsible for ensuring you have the right to share these photos and that the linked content remains accessible. We are not responsible for content hosted on third-party services.

Travel Information Disclaimer

The Aware Traveler provides travel information including visa requirements, currency conversion estimates, weather forecasts, tipping etiquette, public holidays, daily budget estimates, and other practical travel information. This information is provided for general guidance only and may be outdated, incomplete, or inaccurate. Visa rules, customs requirements, prices, and local conditions change frequently. You are solely responsible for verifying current requirements with official sources (government websites, embassies, official tourism boards) before making travel decisions. We are not responsible for any loss, damage, missed connections, denied entry, financial loss, illness, injury, or inconvenience resulting from reliance on information provided through the Service.

AI-Assisted Features

The Service can generate suggested itineraries and related content using AI provided by Anthropic. AI output is provided "as is", may be inaccurate or incomplete, and is not professional travel, visa, immigration, medical, financial, or legal advice. You are solely responsible for independently verifying visa requirements, entry rules, health guidance, costs, and local laws before relying on any AI-generated content.

Affiliate Links

The Service contains affiliate links to third-party products and services including Klook, Airalo, Bytesim, and others. When you click an affiliate link and complete a purchase, we may earn a commission at no additional cost to you. We only recommend services we believe are useful, but we are not responsible for the products, services, prices, refund policies, or experiences provided by these third parties. Your transactions with affiliate partners are governed by their own terms and policies.

Collaborator Trips

You can invite others to collaborate on your trips. When you invite a collaborator:

  • They can view, and if granted editor permissions, edit the trip
  • They can sync days individually and add their own activities
  • Unsyncing a day from your trip is permanent
  • You remain the trip owner and can remove collaborators at any time

When you accept an invitation to a collaborator trip, all days are synced by default. You can unsync individual days, but the action is permanent. You can leave the trip at any time, which removes your access.

User Conduct

You agree not to:

  • Use the Service for any unlawful purpose
  • Harass, threaten, or harm other users
  • Attempt to gain unauthorized access to other accounts or our systems
  • Use automated tools (bots, scrapers) to access the Service without our written permission
  • Reverse engineer, decompile, or attempt to extract source code
  • Interfere with the Service's operation
  • Use the Service to send spam or unsolicited communications
  • Misuse affiliate links (e.g. cookie stuffing, fraudulent referrals)
  • Violate any applicable laws in your jurisdiction or the destinations referenced

Intellectual Property

Our IP

The Service, including its design, code, logos, written content (excluding user-generated content), and other materials, is owned by The Aware Traveler and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works without our written permission.

Country Guide Content

Country guide content (visa rules, currency information, tipping etiquette, etc.) is compiled by us from public sources. While individual facts are not copyrightable, the compilation, structure, and presentation are.

Termination

You may delete your account at any time by contacting us at [email protected]. We may suspend or terminate your account, with or without notice, if you violate these Terms, engage in fraud or abuse, or for any reason at our discretion. Upon termination:

  • Your access to the Service ends
  • Your private data is deleted within 30 days
  • Public content you've shared may remain visible until removed (see Privacy Policy)

Sections that by their nature should survive termination (intellectual property, disclaimers, limitations of liability, indemnification, dispute resolution) will remain in effect.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR AVAILABILITY. We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • Information on the Service is accurate, complete, or current
  • Any defects will be corrected
  • The Service is free of viruses or harmful components

You use the Service at your own risk.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE AWARE TRAVELER, ITS OWNERS, EMPLOYEES, AGENTS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) USD $50. Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above may not apply to you.

Indemnification

You agree to indemnify and hold harmless The Aware Traveler from any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your Content

Modifications to the Service and Terms

We may modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We may also update these Terms from time to time. When material changes are made, we will notify you by email or by posting a notice on the Service. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

Governing Law and Disputes

These Terms are governed by the laws of the Philippines, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Service will be resolved in the courts of Quezon City, Philippines, unless required otherwise by applicable consumer protection law in your jurisdiction. If you are a consumer in the European Union, nothing in these Terms affects your statutory rights under EU consumer protection law.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
